THIS PRIVACY POLICY AND NOTICE DESCRIBES HOW PERSONAL INFORMATION MAY BE COLLECTED, USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
This Privacy Policy covers how Toivoa Coaching collects, receives, uses, processes, retains, and discloses personal information. We may provide additional privacy notices to individuals at the time we collect their personal information. To the extent that we collect Protected Health Information (“PHI”) that is subject to the Health Insurance Portability and Accountability Act, as amended, our Notice of Privacy Practices would apply. These additional privacy notices may supplement this Privacy Policy or may apply in lieu of this Privacy Policy.
CHANGES TO OUR PRIVACY POLICY
We may revise this Privacy Policy from time to time at our sole discretion. If there are any material changes to this Privacy Policy, we will notify you as required by applicable law. You understand and agree that you will be deemed to have accepted the updated Privacy Policy if you continue to engage with Toivoa Coaching after the new Privacy Policy takes effect.

The categories of personal information we collect depend on how you interact with us, Toivoa Coaching, and the requirements of applicable law. We collect information that you provide to us and information we obtain automatically, when
Personal Information You Provide to Us Directly
We may collect personal information that you provide to us.
- Applicant Personal Data. During application, recruitment, onboarding, and training, through to certification process, Toivoa Coaching may collect, store, and process applicant personal data directly from you. This may include identification and contact details such as name, address, telephone/email address, ID/passport, bank account details and social security numbers. Toivoa Coaching may also collect data including applicant academic and professional qualifications, CV/Resume, transcripts and employment references, cover letters, URL links to online platforms such as LinkedIn, other social network and career sites, portfolio sites; and, information about work eligibility, such as immigration status, work authorizations, and visas; and, any other information to support the recruitment process and voluntary disclosure including racial/ethnic origin, military status, disability status, and gender for government reporting obligations and/or ongoing equal opportunities and diversity monitoring, where permitted by law. Applicants may also provide information necessary to arrange accommodation access in the recruitment, training, and Toivoa Inc. hiring process. Applicants may also provide Toivoa Coaching with unsolicited data. In all cases, Toivoa Coaching will handle such sensitive information in accordance with applicable laws.
- Regulatory Information. We may collect personal information where required to comply with regulatory requirements, including information relating to any adverse events you may have experienced when using our Service.
- Your Communications with Us. We may collect personal information, such as email address, phone number, or mailing address, when you request information about our Services, register for communications from us, request customer or technical support, or otherwise communicate with us.
Personal Information Collected Automatically
We may collect personal information automatically.
- Automatic Collection of Personal Information. We may collect certain information automatically when you use our Services, such as your Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, location information (including approximate location derived from an IP address if applicable), and service provider. We may also automatically collect information regarding your use of the Toivoa Coaching, information about the links you click, the types of content you interact with, the frequency and duration of your activities, and other information about how you use Toivoa Coaching.

Recruitment, Training, Certification Process. Toivoa Coaching will your information to in its recruitment, training, certification, and hand over to Toivoa Inc. hiring process. Applicant personal data is used for purposes such as:
- Determining the applicant’s qualifications, skills and background for a particular position.
- Determining the applicant’s right to work.
- Conduct background checks and similar inquiries with applicable laws, and otherwise comply with all applicable laws.
- Communicating with an applicant during the recruitment process.
- Carrying out functions in relation to an applicant’s future employment.
- Managing and improving Toivoa Coaching’s recruitment process, training, certification, and Toivoa’s hiring process.
- Understanding, promoting, and assisting in ensuring that our recruitment, training, certification, and hiring hand -off to Toivoa process is diverse and inclusive.
Processing or your applicant personal data may also be necessary to allow Toivoa Coaching to comply with a legal or regulatory obligation. An example of this would be where Toivoa Coaching is required to retain candidate records for fixed periods of time to comply with local legal requirements.
Administrative Purposes.We use your information for various administrative purposes, such as:
- Pursuing our legitimate interests, such as research and development, network and information security, and fraud prevention.
- Detecting security incidents, protecting against malicious, deceptive, fraudulent or illegal activity, and prosecuting those responsible for that activity.
- Measuring interest and engagement in Toivoa Coaching.

Transfer of Your Personal data between Affiliated entities. Your personal data may be disclosed among various affiliates companies. Your data may additionally be shared with certifying body, National Board for Health and Wellness Coaches. Your data may be shared with our affiliate company, Toivoa Inc. in its hiring process.
Transfer of Your Personal Data to Third Party Service Providers. During recruitment, training, certification activities, and handover to Toivoa Inc. for hiring, Toivoa Coaching may make personal data available to third parties who provide support. Toivoa Coaching will do so when a transfer is necessary and in accordance with applicable data protection rules
Your personal data may be made available to the following types of providers:
- Companies that provide or help operate applicant, trainee, certification, and affiliate companies database.
- Companies that help with payroll services.
- Companies that help with verification and background checking services.
- Companies that help with experience surveys.
- Cloud services that provide hosting, data storage, and other services pursuant to standard terms and conditions that may be non-negotiable.
- Companies that help manage recruitment, training, and certification lifecycle.
- Companies that work with applicant tracking systems.
- These service providers may change over time, but Toivoa Coaching will always use trusted service providers who handle your data in a manner consistent with this privacy policy.
Transfer of your personal data in certain limited circumstances. These situations include but are not limited to:
- To establish, exercise or defend against potential, threatened or actual litigation.
- Where necessary to protect Toivoa Coaching, your vital interests, or vital interests of another person.
Disclosures to Protect Us or Others. Note that you will continue to receive transaction-related emails regarding products or Services you have requested. - Text Messages. If you receive an unwanted text message from us, you may opt out of receiving future text messages from us by following the instructions in the text message you have received from us or by otherwise contacting us as set forth in “Contact Us” below.
- Mobile Devices. We may send you push notifications through your mobile device. You may opt-out from receiving these push notifications by changing the settings on your mobile device. With your consent, we may also collect precise location-based information through your mobile device. You may opt out of this collection by changing the settings on your mobile device.
- Phone calls. If you receive an unwanted phone call from us, you may opt out of receiving future phone calls from us by following the instructions that may be available on the call or by otherwise contacting us as set forth in “Contact Us” below.
- “Do Not Track.” Do Not Track (“DNT”) is a privacy preference that users can set in certain web browsers. Please note that we do not respond to or honor DNT signals or similar mechanisms transmitted by web browsers.
Your Privacy Rights. In accordance with applicable law, you may have the right to:

CALIFORNIA SHINE THE LIGHT
The California “Shine the Light” law permits users who are California residents to request and obtain from us once a year, free of charge, a list of the third parties to whom we have disclosed their personal information (if any) for their direct marketing purposes in the prior calendar year, as well as the type of personal information disclosed to those parties.
CHILDREN’S INFORMATION
Toivoa Coaching is not directed to children under 13 (or other age as required by local law), and we do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has uploaded personal information to our site without your consent, you may contact us as described in “Contact Us” below. If we become aware that a child has provided us with personal information in violation of applicable law, we will delete any personal information we have collected unless we have a legal obligation to keep it.
THIRD-PARTY WEBSITES/APPLICATIONS
Toivoa Coaching website may contain links to other websites, applications and other websites/applications may reference or link to Toivoa Coaching. These third-party services are not controlled by us. We encourage our users to read the privacy policies of each website and application with which they interact. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk.
